If you are searching the internet about punishments for a first or subsequent DUI conviction, you should stop. The grids you are incessantly reviewing and likely panicking over are simply minimum and maximum penalties. However, if you get good legal counsel, there is a high probability your case will not be resolved as a DUI conviction. In that case, those grids have been absolutely no help whatsoever…and your stress was for nothing. So, stop wasting time looking at the sentencing grid!
So, What IS My First Step After A DUI Arrest?
Obviously, call a defense attorney in the area where you were investigated for DUI. Local matters because not every jurisdiction offers the same options for resolution, including jail alternatives.
For example, if you were arrested in Lacey, Washington, it makes no sense to call a firm in Seattle. While there are state laws governing the crime of DUI, the application of those laws vary drastically from city to city and county to county. Furthermore, the culture of the prosecutors office where you were arrested has an enormous impact
DOL Request
You only have 7 days after your DUI arrest to apply for the Department of Licensing hearing. If you do not apply, you will be automatically suspended approximately 30 days from your arrest. This is an administrative suspension and does NOT substitute or “count as” your suspension for the criminal side of the case.
However, it is possible to “win” your criminal case but still be suspended from the DOL. So, increase your odds of avoiding a license suspension by applying for the DOL hearing.
DOL Account
We get many questions about driving privileges, suspension rules, “blow and go” rules for DOL suspensions, and so much more! The truth is, only DOL can tell you what DOL will do. The DOL side of your DUI case is administrative so it runs separately from your criminal case.
If you really want to know what is “holding up” your license or how to get reinstated, one of the best tools you can use is a License eXpress account. As long as you have a Washington State issued license, this account will provide the details regarding your license suspension and all of the steps you must take to get your license reinstated.
Unfortunately, if you have an out of state license, you will only be able to call the Washington DOL and your home state DOL to try to figure out what needs to be done to have your driving privileges reinstated.
Driving Privilege – License Suspension
If you become a client, we will talk immediately about your ability to drive regardless of whether you become suspended due to DOL or the criminal case. There are several critical steps (you must do all of them) that allow you to drive during your time of suspension. Again, if we represent you, this will be part of your step by step plan.
